This Act comes into force on 1 July 2019.
However, the following provisions come into force on 3 December 2018:
- Part 1 of this Act (amendments to Bail Act 2000):
- Part 3 of this Act (amendments to Crimes Act 1961):
- Part 5 of this Act (amendments to Evidence Act 2006).
This Part amends the Bail Act 2000 (the principal Act).
In section 3, insert in their appropriate alphabetical order:
family violence offence means an offence—
- against any enactment (including the Family Violence Act 2018); and
- involving family violence (as defined in section 9 of that Act)
After section 3, insert:
Repeal section 3AA on 1 July 2019.
Replace section 7(2) with:
A defendant is bailable as of right who is charged with an offence for which the maximum punishment is less than 3 years’ imprisonment, unless the offence is one against—
- section 194 of the Crimes Act 1961 (which relates to assault on a child, or by a male on a female); or
- section 194A of the Crimes Act 1961 (which relates to assault on a person with whom the...
